X-1FBO Connector for Microsoft Dynamics 365 Business Central

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and GMSTEK LLC ("Provider") for the use of the X-1FBO Connector ("Software"), a Business Central ("BC") application that facilitates integration between X-1FBO, a SaaS platform, and Microsoft Dynamics 365 Business Central.
By downloading, installing, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Software.
1. License Grant
1.1 Scope of License
Provider grants User a non-exclusive, non-transferable, and revocable license to use the Software solely for the purpose of integrating an X-1FBO instance with Microsoft Dynamics 365 Business Central.
1.2 Limitations
The Software is provided free of charge but requires a valid and active subscription agreement for the X-1FBO SaaS platform ("X-1FBO Subscription") to function. The X-1FBO Subscription is managed outside of Business Central and is subject to separate terms and conditions.
2. Requirements and Dependencies
2.1 X-1FBO Subscription
The Software cannot operate independently and requires a fully configured and active X-1FBO instance. Users without an X-1FBO Subscription will not be able to utilize the integration features provided by the Software.
2.2 Microsoft Dynamics 365 Business Central
User must have access to a valid installation of Microsoft Dynamics 365 Business Central.
2.3 Configuration
If specified in the X-1FBO agreement, GMSTEK staff will provide technical support in the configuration of the X-1FBO Connector.
3. Use Restrictions
3.1 Permitted Use
The Software may only be used in conjunction with a valid X-1FBO instance.
3.2 Prohibited Use
User may not:
a. Modify, reverse engineer, decompile, or disassemble the Software.
b. Use the Software to develop competing products or services.
c. Use the Software in violation of applicable laws or regulations.
4. Ownership and Intellectual Property
4.1 Ownership
The Software and all associated intellectual property rights remain the exclusive property of Provider.
4.2 Third-Party Software
The Software may include components licensed from third parties. Such components are subject to their own license terms.
5. Disclaimer of Warranties
5.1 No Warranty
The Software is provided "as is" without warranty of any kind. To the maximum extent permitted by law, Provider disclaims all warranties, whether express, implied, statutory, or otherwise, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
6.1 Exclusion of Damages
To the maximum extent permitted by law, Provider shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the Software, even if advised of the possibility of such damages.
6.2 Liability Cap
The total liability of Provider for any claims related to the Software shall not exceed the amount paid by User for the Software, which in this case is zero because the Software is provided free of charge.
7. Termination
7.1 Term
This Agreement is effective until terminated.
7.2 Termination by Provider
Provider may terminate this Agreement at any time if User violates any terms herein.
7.3 Effect of Termination
Upon termination, User must immediately cease using the Software and uninstall all copies.
8. Telemetry and Diagnostics
8.1 Diagnostic Telemetry
The Software may transmit limited publisher-scoped diagnostic telemetry to GMSTEK LLC for the purpose of detecting, investigating, and resolving synchronization failures, monitoring product health, and improving the reliability of the Software.
8.2 Scope of Diagnostic Data
The diagnostic telemetry described in this Section is limited to technical and operational metadata related to the Software and its execution, such as tenant or environment identifiers, Business Central version, extension version, event identifiers, timestamps, error codes, object identifiers, durations, and counts.
The Software is designed so that no customer business data, transaction content, or personally identifiable information is transmitted as part of this diagnostic telemetry.
8.3 Customer Control
The Software includes an in-product setting labeled "Share Diagnostics with GMSTEK" that allows the customer to disable this diagnostic telemetry. If the setting is disabled, GMSTEK will not receive publisher-scoped diagnostic telemetry from the Software.
8.4 Privacy Statement
Additional information regarding GMSTEK's handling of diagnostic telemetry, including applicable retention, access, and data subject request practices, is provided in the GMSTEK Privacy Statement available at:

8.5 Acceptance
By installing or using the Software, User acknowledges that the Software may transmit the diagnostic telemetry described in this Section unless the customer disables that feature through the Software's configuration.
9. Privacy
9.1 Data Collection
Except for the diagnostic telemetry described in Section 8, the Software does not independently collect, store, or process User data. However, the integration with X-1FBO and Microsoft Dynamics 365 Business Central may involve the transfer of data between these platforms, which is governed by their respective privacy policies and applicable agreements.
9.2 Privacy Policies
User is encouraged to review the privacy policies of X-1FBO, GMSTEK, and Microsoft Dynamics 365 Business Central for details on how data is handled.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
